TERMS AND CONDITIONS FOR TRAINING COURSES

General

ALL bookings should be accompanied by the appropriate booking form. Telephone bookings must be confirmed in writing. You will receive written confirmation from ourselves, normally within 5 working days of receipt of your request. Unless agreed in writing payment for any Course is due in full, in sterling, not less than 7 days prior to the commencement of the course.

Your booking confirmation will indicate whether a deposit is required. ALL Course fees and other charges are exclusive of Value Added Tax.

Course candidates may be substituted at any time prior to the commencement of the Course, provided that we are notified in writing.

Cancellations must be made in writing and only take effect on date of receipt. If a cancellation is received at least 2 weeks before the start of a Course, 30% of the agreed fees will be charged. If a cancellation is received at least 1 week before the Course, 60% of agreed fees will be charged. If cancellation is received at least 2 days before the Course, 80% of agreed fees will be charged. The Full Course fee will be due for cancellations with less than 2 days notice or for non attendance.

We reserve the right to cancel an Open Course if insufficient bookings are received 7 days prior to the course when a full refund of Course fees will be made.

We also reserve the right to cancel a booking or a Course for non-payment of fee in addition to our rights under 5 above.

We reserve the right not to admit or to expel candidates without liability if in our absolute discretion their behaviour is inconsistent with our reputation or the management of the course. We reserve the right to change the content and timetable of a Course if, in doing so, the objectives of the Course can be better met.

Where practicable we will notify you of any proposed changes. Each candidate must inform us in writing at least 14 days prior to a Course of any medical condition which may affect them or others (e.g. epilepsy, diabetes). We will keep such information in confidence.

In addition for courses that may involve physical activity, it is the responsibility of each candidate to take appropriate medical advice to ensure that they are fit to take part. We shall have no liability for any consequence of force majeure including but not limited to severe weather, acts of Government, strikes, transport delays, unavailability of personnel due to illness.

These conditions apply to the provision of Training Courses to the exclusion of all other terms whether in writing or otherwise, unless both parties agree other specific written terms and conditions.
 
Insurance

Pro Active Safety Training has a Combined Liability Insurance with a reputable quality training and service provider Insurer. A copy of the Company's insurance certificate can be provided upon request. Any claims arising as a result of the actions of Pro Active Safety Training or its tutors/instructors should be addressed to Pro Active Safety Training in writing giving full details of the basis of your claim and evidence should be supplied at the time of writing, any accident book pages should be copied and supplied.

Alterations or Cancellations

Whilst every attempt is made to ensure that the all tasks run by Pro Active Safety Training reserves the right to vary or cancel any agreed terms should this become necessary, i.e. due to Health & Safety Issues, or Venue cancellation? In the most unlikely event of cancellation by Pro Active Safety Training, alternatively a full refund will be paid in full to the client, there are times when neither party can be held responsible and an agreement would be made through our company solicitors.

Course Cancellation

Please note that in the event of a course being cancelled due to lack of numbers or circumstances beyond our control Pro Active Safety Training will offer a full refund of the course fee and you will be offered a place on a future course.  We cannot be held responsible for any other costs incurred by clients as a result of a course cancellation.

Delegate Safety

You must comply with the safety regulations and instructions of Pro Active Safety Training staff and tutors at all times. Should you be found that you are jeopardising the health, safety and welfare of others, then you will be asked to leave the course, and no refund will be given.

Any candidate who appears to be under the influence of any alcohol or drugs will be removed from the course immediately and no refund will be given. Any candidate who is under prescribed medication must bring this to the tutor/trainer/instructors attention immediately.

Pro Active Safety Training reserves the right to all information provided in handouts and presented to delegates by the company is protected by copyright and other intellectual property laws. You may not reproduce copy or transmit, in any form or by any means, electronic, mechanical, recording or otherwise, without the prior written permission of the company, the company does give permission when prior consent has been sourced and the use of electronic recording systems such as for the use in TV is to be used, please contact Pro Active Safety Training for more information on this should you require to do so. 

This contract is construed under Scots and English Law.
